We can’t always expect things to go as planned.

Take, for instance, the Super Bowl. The Broncos left the season as the best offensive team. Led by their quarterback- one of the best quarterbacks of all time- Peyton Manning, the Broncos had a record-breaking season, and were mostly favored to win. Yet, the big game comes along, and the Broncos get flattened. Steamrolled. Decimated. (Insert your Armageddon-ish verb here.)

Sometimes life is predictable, but since it is often not, it is best to be ten steps ahead of it. Frequently, we get calls about serious injuries with potentially good claims. Then we inquire as to the date of loss, and it turns out that the injury was three, five, or sometimes even ten years ago. People often have good reasons for not calling sooner. Life just gets in the way. But whether you agree with it or not, there is a limitation period of two years for most personal injury situations. In some instances, the limitation period could be even shorter than two years. For example, for long term disability or short term disability applications, the limitation period may be dictated by the insurance company that holds the policy. And beside for a limitation period, there may also be a notice requirement with a given deadline (for example, there is a ten day notice period for injuries incurred on municipal properties- you can read more about that here). It is certainly understandable that under distress from a recent injury, your first thought is not to call the fine people at Bergel, Magence, LLP (we are only slightly offended) or any other law firm for that matter. However, that also does not necessarily mean that you get to recover before calling a lawyer. In fact, if you do have a lawyer involved from the beginning, it will probably allow you some ease of mind so that you can recover faster. It also gives your lawyer the opportunity to better build your case, and advocate for the compensation you deserve.
