Long Term Disability & Short Term Disability
Many people have access to short term and long term disability insurance through private insurance policies or group insurance policies (eg. through their employers). The provisions of each policy are unique so the applicable policy should be carefully reviewed to determine the rights and obligations of the insurer and the insured.
There are usually strict deadlines set out in the policy within which an insured must apply for disability insurance. There is usually a deadline set out in the policy written which an insured must commence a civil court action in the event that benefits are terminated or denied. If a benefit is terminated or denied, an insured person should immediately obtain a copy of the policy and consult with a lawyer to discuss his or her rights. Many policy holders become confused by correspondence from the disability insurers wherein the insurer terminates benefits but invites them to send in further documents to “appeal” the decision. The time-frame for this “appeal” is usually set out in the correspondence but is unrelated to the limitation period within which a court action must be commenced.
The “appeal” is in reality simply a request to the insurer that it reconsider its decision. If a civil court action is not commenced within the limitation period set out in the policy, the claim may be statute barred.
The most effective way to obtain a remedy from a disability insurer which has refused or terminated benefits is to commence a civil court action which should be done through a lawyer.

WSIB
If your injury takes place while you are working, you may be covered by what used to be known as worker’s compensation.
WSIB claimants who benefit from WSIB cannot sue as well. Always call Hy Bergel to discuss which option to choose as in certain situations there are options.
For example: If you have a car accident while working and one of the parties to the accident was not at work during the crash, there may be an election available which would let you opt out of WSIB.
